Eminent domain (or condemnation) is the forceful taking of private property from an individual/entity who is unwilling to sell. This is, without a doubt, the most expensive form for real estate acquisition. It is lengthy, requires many hours of legal time, is a drain on government resources, and is not the method by which McEagle seeks to acquire any piece of ground within the redevelopment area.

Overall, McEagle does not wish to go through the process of eminent domain for a single parcel within the redevelopment area. As Paul McKee stated, "We will not use eminent domain to get a house just to tear it down and build another house."

Upon submittal of the redevelopment proposal to the City of St. Louis, McEagle is prohibited from using eminent domain to take property from those within the redevelopment area. Please see page 16 of the TIF Application for a detailed description.
